Peter,

yes, this is expected to work. I am not aware of any incompatible
changes in this upgrade.

You can also change the location of the data directory:

Note that some upgrades can change the data directory in ways that
prevent later downgrade:
http://docs.geoserver.org/latest/en/user/installation/upgrade.html
http://docs.geoserver.org/latest/en/user/datadirectory/migrating.html

It is safest to have a backup. Upgrading by copying the data directory
as you describe is also safe.
